These booking terms clearly and comprehensibly govern the contracting of nautical experiences offered by OneDay Barcelona through its website https://onedaybarcelona.com, as well as through other contact channels such as web forms, telephone or WhatsApp Business.

We recommend that you read this text carefully before confirming your booking. If you have any questions, you can contact us and we will help you resolve any issue related to your sailing trip or nautical experience.

1. Purpose of the terms

The purpose of these terms is to regulate the bookings and booking requests for nautical experiences (sailing trips, private activities, sunrise or sunset outings, celebrations and other services related to nautical tourism) made in favour of OneDay Barcelona through:

  • Contact and information request forms.
  • The contact telephone number indicated on the website.
  • WhatsApp Business or other communication channels enabled by OneDay Barcelona.

By requesting or confirming a booking you accept these booking terms, without prejudice to any specific conditions that may apply to particular services and to the consumer and user regulations that may apply at any given time.

Hereinafter, BARCELONA SAIL DREAMS S.L. may be referred to indistinctly as "OneDay Barcelona" or "the company".

3. Description of the experiences

OneDay Barcelona offers different types of nautical experiences in Barcelona. Each experience will have its own specific information sheet or description on the website or during the booking process, where the following will be clearly indicated, among other aspects:

  • Name of the activity (for example, sunset sailing trip, private experience, celebration, etc.).
  • Approximate duration of the experience.
  • Planned date and time of departure.
  • Departure or meeting point, which may also be provided via an external Google Maps link.
  • Price and, where applicable, specific payment conditions.
  • Maximum capacity of participants allowed.
  • Services included (for example, boat, skipper, fuel or other items detailed in each case).
  • Services not included, where relevant (for example, transport to the harbour, meals not indicated, etc.).
  • Requirements or recommendations (recommended minimum age, suggested clothing or footwear, physical conditions, etc.).

4. Booking process

The booking process for nautical experiences is straightforward and may vary slightly depending on the contracting channel. In general terms:

  1. Selection or request for the experience: The user chooses a specific experience from the website or describes it in their request by telephone, form or WhatsApp Business.
  2. Required information: The user indicates the desired date and time, the number of people who will take part and the basic contact details requested (for example, name, telephone number, email address).
  3. Availability: All bookings are initially subject to availability of the boat, skipper and operational conditions for the requested date and time.
  4. Payment or deposit (if applicable): Depending on the type of experience, OneDay Barcelona may request full payment or a deposit to block the booking.
  5. Confirmation by OneDay Barcelona: The booking will be considered firmly confirmed when OneDay Barcelona confirms availability and, where appropriate, the indicated payment or deposit has been received.

OneDay Barcelona may contact you by telephone, email or WhatsApp Business to confirm details of the trip, clarify any questions or request additional information necessary to provide the service under appropriate safety and quality conditions.

5. Price and method of payment

The prices of the nautical experiences will always be indicated in euros (€) and will be shown on the information sheet for each activity or clearly communicated during the booking process.

Unless expressly stated otherwise, the following rules will apply:

  • The applicable price will be the one stated on the experience’s information sheet at the time of booking or the one confirmed to you by OneDay Barcelona via the communication channel used.
  • Payment may be made via the secure payment gateway Redsys or other means accepted by OneDay Barcelona (for example, bank transfer or other systems, when expressly offered).
  • OneDay Barcelona does not store your full bank card details. Payment data is processed through the corresponding gateway, in accordance with its own security measures.
  • Depending on the experience, full payment in advance, payment of a deposit or leaving a pending amount to be paid at a later time (for example, before boarding) may be required, always in accordance with what is indicated on the information sheet or in the booking communication.
  • If payment of a deposit or a specific amount is established to formalise the booking, it may not be considered confirmed until OneDay Barcelona has received and verified such payment.

6. Invoicing

If you need an invoice for the services contracted, you can request it from OneDay Barcelona. In order to issue it correctly, you may be asked for the necessary tax information, such as name or company name, tax ID and tax address.

Invoices will be issued in accordance with the applicable tax regulations in force at any given time and may be provided in electronic format or another suitable medium.

7. Booking confirmation

Once availability has been verified and, where appropriate, the indicated payment or deposit has been received, OneDay Barcelona will proceed with the booking confirmation through the communication channel used by the client, such as:

  • Email.
  • Telephone.
  • WhatsApp Business.
  • Other means that have been reasonably used during the booking process.

It is the client’s responsibility to check that the booking details are correct (date, time, number of people, type of experience, meeting point, etc.).

If you notice any error or discrepancy, you must inform OneDay Barcelona as soon as possible in order to try to correct it, always subject to availability and to the applicable change or cancellation conditions.

8. Punctuality and meeting point

To ensure the proper running of the experience and to respect the sailing schedules and those of other participants, punctuality is very important.

  • The client must arrive at the meeting point indicated in the booking with the minimum advance time stated on the experience’s information sheet or in communications from OneDay Barcelona.
  • The meeting point and exact location may be provided via an external Google Maps link or similar geolocation tools.
  • Client delay may entail a reduction in the actual duration of the experience, in order to comply with sailing schedules, subsequent bookings or operational obligations.
  • If the delay is such that it prevents the trip from taking place under the planned conditions, it may be considered as a no-show, in which case the applicable Cancellation Policy will apply.

9. Capacity and participants

For safety reasons and in order to comply with maritime regulations, each experience has a maximum capacity of participants.

  • The authorised capacity indicated on the experience’s information sheet or in the booking confirmation may not be exceeded.
  • Minors must always be accompanied by a responsible adult, who will be responsible for their behaviour and wellbeing during the activity.
  • The client undertakes to inform in advance if there are minors, people with reduced mobility, special needs or any other circumstances that may be relevant to the safety and proper organisation of the trip.
  • The admission of pets on board will only be allowed when so indicated in the description of the experience or when OneDay Barcelona expressly confirms it in advance. In case of doubt, it is essential to consult this before booking or, at the latest, before boarding.

10. Safety on board

The safety of people, the crew and the boat is a priority for OneDay Barcelona.

  • Throughout the activity, passengers must follow at all times the instructions of the skipper or the person responsible for the experience.
  • The skipper or person in charge of the activity may modify the route, schedules, duration or type of activity initially planned when deemed necessary for safety reasons, sea conditions, weather, port operations or other justified causes.
  • No form of dangerous or disrespectful behaviour or behaviour that could compromise the safety of oneself, third parties, the crew or the boat will be allowed.
  • OneDay Barcelona, through its staff or the skipper, may deny boarding or end the activity early if inappropriate conduct or risk situations are detected (for example, intoxication, use of prohibited substances, aggression, repeated failure to follow instructions, etc.).

These decisions will always be taken with the primary aim of protecting safety and the proper running of the experience.

11. Weather and sea conditions

Nautical activities depend on external factors such as weather and sea conditions, which may change at short notice.

  • The final decision on the safety and feasibility of the trip will always rest with OneDay Barcelona, the skipper or the person in charge of the activity, based on weather forecasts, sea conditions, warnings from the authorities and other technical and operational criteria.
  • If OneDay Barcelona cancels the experience due to adverse weather, sea conditions, safety reasons, boat breakdown, port restrictions or force majeure, the client will be offered, in a balanced manner:
  • A change of date to carry out the experience at another time, subject to availability.
  • Or a refund of the amount paid for the booking, under the terms and within the timeframes agreed.
  • Light rain, cloudiness or other conditions that may be considered less than ideal but do not compromise the safety of navigation do not necessarily imply cancellation of the trip.
  • Cancellation on safety grounds will not be based solely on the client’s subjective preference, but on technical and operational criteria assessed by OneDay Barcelona and the skipper.

12. Changes requested by the client

If, after making a booking, you wish to change the date, time or certain details of the experience (for example, number of participants within the maximum capacity), you must contact OneDay Barcelona as soon as possible.

  • Date or time changes will always be subject to availability of the boat, skipper and operational conditions.
  • OneDay Barcelona will make every effort to accommodate reasonable changes whenever possible and without prejudice to other confirmed bookings.
  • Changes requested at short notice may be treated in a similar way to a cancellation, in which case the provisions of the Cancellation Policy will apply.

13. Cancellation policy

OneDay Barcelona has its own Cancellation Policy, which may be detailed on a specific page or in a separate document. For information purposes, and in summary form, the following criteria will generally apply, unless different conditions are indicated for a specific experience:

  • Cancellations made more than 48 hours in advance of the scheduled departure time: the client may choose between a 100% refund of the amount paid or a change of date, subject to availability.
  • Cancellations between 24 and 48 hours before departure: 50% of the amount paid will be refunded.
  • Cancellations less than 24 hours in advance: in this case, no refund will be made, unless the particular conditions of the experience state otherwise.
  • Client’s failure to appear at the meeting point at the indicated time: this will be considered as a late cancellation and therefore no refund of the amount paid will be made.
  • If OneDay Barcelona is forced to cancel the experience due to adverse weather, sea conditions, safety reasons, breakdown, port restrictions or force majeure, the client will be offered a change of date or a refund of the amount paid.

In any case, it is recommended to consult the full and up-to-date Cancellation Policy on the website or request it from OneDay Barcelona before confirming the booking.

14. Right of withdrawal

OneDay Barcelona’s nautical experiences are generally booked for a specific date and time, which has implications regarding the right of withdrawal.

In accordance with current consumer regulations, for services related to leisure activities (such as sailing trips and nautical activities) scheduled for a specific date or period of performance, the legal right of withdrawal may not apply under the same terms as for other distance-contracted services.

In any event, regardless of whether or not the right of withdrawal applies in each specific case, the client may always cancel their booking in accordance with OneDay Barcelona’s Cancellation Policy described in the previous section.

15. Client’s responsibility

By making a booking, the client undertakes to:

  • Inform in advance of any relevant circumstances for the proper provision of the activity, especially in relation to safety (for example, health conditions, reduced mobility, minors, etc.).
  • Be responsible for arriving on time at the indicated meeting point, with the required advance notice.
  • Make respectful and diligent use of the boat, equipment and materials made available.
  • Respect at all times the safety instructions given by the skipper or OneDay Barcelona staff.
  • Be liable for any damage and loss that may arise from negligent, reckless or instruction-defying conduct, to the extent established by the applicable regulations.

16. OneDay Barcelona’s responsibility

OneDay Barcelona undertakes to provide its services with the professional diligence reasonably required in the organisation of nautical experiences and nautical tourism.

  • OneDay Barcelona may modify, reschedule or cancel the activity when there are safety reasons or justified causes, such as adverse weather, sea conditions, port restrictions, technical breakdowns or force majeure situations.
  • OneDay Barcelona will not be liable for delays, changes or failures to perform attributable to force majeure, weather conditions, authority restrictions, unforeseeable breakdowns, actions of third parties or, in general, causes beyond its reasonable control.
  • Absolute availability of all services or the performance of activities under any conditions is not guaranteed, given the inherently changing nature of the marine environment.

All of the above is without prejudice to any liabilities that may, where appropriate, be legally enforceable against OneDay Barcelona in accordance with the applicable regulations on navigation, tourism and consumer and user protection.

17. Personal belongings

The client is the sole responsible party for personal belongings taken on the experience (clothes, mobile phones, cameras, documents, money, etc.).

  • It is recommended not to bring on board unnecessary valuables or large amounts of cash.
  • OneDay Barcelona will not be liable for the loss, damage or theft of the client’s personal belongings, except in those cases where liability is legally enforceable in accordance with the applicable regulations.

18. Language of the activity

Communications with OneDay Barcelona and the running of the nautical experiences may be carried out, depending on the specific activity and the availability of the team, in the following languages:

  • Spanish.
  • Catalan.
  • English.
  • Other languages that may be available at certain times, subject to confirmation by OneDay Barcelona.

If you have a preference for a particular language, it is advisable to indicate this when making your booking so that OneDay Barcelona can confirm it or, where appropriate, propose alternatives.

19. Personal data protection

The personal data collected during the booking process and in communications with OneDay Barcelona will be processed in accordance with the company’s Privacy Policy, which will be available on the website.

In the event of conflict or discrepancy in the interpretation or application of these terms, the provisions of the consumer and user regulations applicable at any given time will apply, as well as the dispute resolution mechanisms provided for in such regulations.

All of this is without prejudice to the client’s right to turn to the competent consumer bodies or to the courts, in accordance with the laws that may apply.
